It looks well-made, but i am not familiar with the brand. i've requested reviews and evaluations of the sam's club product, just in case, and i've also widened my search to include specials, clearances etc., in order to get the best "bang for the buck." i did come across what appears to be a great deal from a maker named denmark (140$ down to 50$) for a 6-quart, oval version. We won't be ordering this for a week or so, so i am definitely keeping my options open, within my budget parameters. i've done quite a bit of reading on the care, use and maintenance of enameled cast iron cookware, and i believe that, with care, the tramontina will serve my purposes well for now. assuming an acceptable manufacture and finish, the only remaining issue is the plastic knob, which can be replaced within a month or two. having four children of various ages, i can always upgrade at a later date and pass along the "budget" model to one of my sons as they go out on their own.īecause of this, the tramontina currently looks like the way to go, and i will be very careful to request some quality control when they select one for shipping, and will inspect it very closely when it arrives. tas and i sat down this morning discussing options, budget etc, and it appears that 50$ (60 tops) is really all we can allocate for this purchase, at least for the foreseeable future. One further feature of the expert evidence is that an expert may rely on information, which in other circumstances, would be regarded as hearsay. Failure to do so will render expert opinion inadmissible. It is also the case that an expert's views on subjects within the understanding of the tribunal are inadmis-sible as explained poignantly by Lawton LJ: "The fact that an expert witness has impressive scientific qualifications does not by that fact alone make his opinion on matters of human nature and behaviour within the limits of normality any more helpful than that of the jurors but there is a danger that they may think it does." By Rule 24 Criminal Procedure Rules in criminal trials the evidence of the expert must be, as soon as practicable, furnished to the other side along with the expert's observations, calculations, and other procedures. Where the tribunal of fact has sufficient knowl-edge and understanding of the subject, it is not necessary to call an expert and this renders expert tes-timony inadmissible, R v. If indeed an expert is required, then evidence of a nonexpert is not admissible. There has long been some difficulty in determin-ing which matters require an expert opinion but, in general, where the evidence to be given is outside the experience of the court, there is a prima facie require-ment for an expert. "An expert was only qualified to give evidence that was relevant if his knowledge and expertise was beyond that of the layman and such evidence had to relate to a factual issue in the case". In the civil courts, the admissibility of expert evidence is governed by section 3 of the Civil Evidence Act 1972 and rules of the court. Middleton 2 QB 766 would seem to agree that the expert need only have exper-tise beyond that of a layman, not that the expert be qualified beyond that of a layman. Silverlock 2 QB 766, an amateur graphologist was allowed to act as an expert on handwriting and a number of cases since have maintained the position that expert status can be obtained by personal expe-rience as well as by formal training. It is the court that decides the validity of the expert witness and it is not necessary, in most cases, that the person called is formally qualified. This duty overrides any contractual obligation that may have been formed between the expert and the party instructing and paying them. There is no such thing as a claimant's or a defendant's expert and, by Rule 35.3 of the Civil Procedure Rules 1998, it is the duty of the expert to assist the court on matters within their expertise. The role of the expert in UK courts is to assist the court itself in deciding the reliability of evidence. ![]() ![]() Clicking a spouse, I would suddenly see that person’s spouses, not the spouses of the person I was editing. Windowing in RM8 is a huge improvement on RM7. Gradually, it has improved as the developers worked through a multitude of issues coupled with keeping it fully compatible with Apple Mac. Sad, really.Īnyway, I’ve now used Family Historian 7 for more than a year and LOVE it. RM9 could be the final downfall of RootsMagic. Now that RM8 has come and gone, and the poor design of RM9 is just as awful, without any truly Earth shattering new features. Family Historian is VASTLY superior to even RM7. Given the severe problems with RM8, I made the switch to Family Historian 7 (as have many others). It seems like RM9 was merely launched to feed the coffers of the developers of RM in order to keep them afloat. RM9 also requires that RM8 data be converted to use with RM9 - and that’s NOT backwards compatible. ![]() The MAJOR issues with RM8 (many of them discussed above) are still there. Well, I made the mistake of obtaining a copy ($20 wasted) only to find that RM9 is essentially the same thing as RM8 but with a few relatively minor and unimportant “features” added. Then, RootsMagic 9 was suddenly launched yesterday, but without all of the fanfare that preceded RM8. MANY more clicks are needed just to enter or find information, surfing through multiple windows is now required when just one will do, screen real estate is wasted, and data are now hidden (unless you want to click through more windows). but what a HORRIBLE interface! It looks more like a clown show at a circus. What an absolute nightmare! Not only was RM8 a major leap BACKWARDS - it’s clunky, complicated, difficult to use, poorly designed, etc. It was (past tense) a great program - not perfect but certainly the best out there for a long time. Will this be the death knell for RootsMagic? I was a very big fan of RootsMagic for more than a decade. ![]() ![]() ![]() This free, uncomplicated app allows sharing of an Android screen with other Android users.
